SENATE BILL 1059

 

 

 

 

An Act

 

establishing the efficacy of Arizona's move over law study committee.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Efficacy of Arizona's move over law study committee; membership; duties; report; delayed repeal

A. The efficacy of Arizona's move over law study committee is established consisting of the following members:

1. Two members of the senate, each from a different political party, who are appointed by the president of the senate. The president of the senate shall designate one of these members to serve as cochairperson of the study committee.

2. Two members of the house of representatives, each from a different political party, who are appointed by the speaker of the house of representatives. The speaker of the house of representatives shall designate one of these members to serve as cochairperson of the study committee.

3. The director of the department of transportation or the director's designee.

4. The director of the department of public safety or the director's designee.

5. Three representatives of the towing and recovery industry, one of whom is appointed by the governor, one of whom is appointed by the president of the senate and one of whom is appointed by the speaker of the house of representatives.

6. Two representatives of law enforcement associations, one of whom is appointed by the president of the senate and one of whom is appointed by the speaker of the house of representatives.

7. Two representatives from a local chapter of a nationally recognized organization that advocates for the motor vehicle interests, one of whom is appointed by the president of the senate and one of whom is appointed by the speaker of the house of representatives.

B. The study committee shall meet at the call of the cochairpersons.

C. Study committee members are not eligible to receive compensation.

D. The study committee shall:

1. Conduct a comprehensive study to determine the efficacy of section 28-775, subsection E, Arizona Revised Statutes, to determine if additional promotion and education of the law are needed to ensure greater effectiveness and additional safety measures to help drivers better comply with yielding to emergency vehicles.

2. Identify any additional resources or policy initiatives that would enhance public safety or improve the efficacy of section 28-775, Arizona Revised Statutes.

3. Propose legislation to address issues identified by the study committee.

4. Review current policies and practices and propose revisions to improve safety matters for first responders and citizens.

5. On or before December 1, 2025, submit a report regarding the study committee's activities, findings and recommendations for administrative or legislative action to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state.

E. This section is repealed from and after September 30, 2026.
