An Act
amending title 9, chapter 4, article 8, Arizona Revised Statutes, by adding section 9-500.40; relating to municipal water service.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-500.40, to read:
9-500.40. Water service outside city or town; requirements
A city or town that provides water service shall provide water service through a standpipe for water HAULING to persons residing outside the city's or town's water service area who do not have access to SUFFICIENT water if all of the following apply:
1. The number of households to be serviced is not more than seven hundred fifty.
2. The city or town previously provided water service to the persons who do not have access to sufficient water.
3. There is no other source of water for those persons within ten miles of their households.
4. The city or town is reimbursed for the costs of providing and delivering the water.
5. Providing the water at the standpipe does not reduce the amount of water AVAILABLE to households within the city's or town's water SERVICE area or to households OUTSIDE of the CITY'S or town's water SERVICE area with whom the city or town has contracted to provide water.
Sec. 2. Conditional repeal; notice
A. Section 9-500.40, Arizona Revised Statutes, as added by this act, is repealed on the following date if one of the following occurs:
1. From and after March 30, 2023, if the corporation commission has not licensed a water provider to service the area prescribed in section 9-500.40, Arizona Revised Statutes, as added by this act, that lacks sufficient water.
2. On the date in which the persons prescribed in section 9-500.40, Arizona Revised Statutes, as added by this act, acquire access to sufficient water supplies.
3. From and after December 31, 2025, if neither condition in paragraph 1 or 2 of this subsection is not met by January 1, 2026.
B. The corporation commission shall notify in writing the director of the Arizona legislative council on or before February 1, 2026 of the date on which the condition was met.
