AN ACT
amending title 16, chapter 6, article 1, Arizona Revised Statutes, by adding section 16-926; relating to campaign contributions and EXPENSES.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 16, chapter 6, article 1, Arizona Revised Statutes, is amended by adding section 16-926, to read:
16-926. Political "do not call" list; robocalls; defense; injunction; legislative actions; political subdivisions; violation; classification
A. A person may not initiate an outbound telephone call to a person in this state in an attempt to influence the outcome of an election if both of the following apply:
1. The telephone call includes a prerecorded or artificial voice.
2. The person receiving the telephone call is listed on the state political "do not call" list established pursuant to this section.
B. The secretary of state shall establish and maintain the state political "do not call" list that shall provide for convenient methods for persons in this state to refuse political telephone calls prescribed in subsection A of this section. The methods shall include a website-based system for persons to be placed on the list and a telephone method for persons to be placed on the list and shall require the name and address of the person and a minimum amount of additional identifying information from the person. The state political "do not call" list is not a public record but on request from a person who is a lawful possessor of voter registration information as prescribed by section 16-168, subsection E, the secretary of state shall provide only the telephone numbers on the political "do not call" list for redaction from that voter registration information. On removal of those telephone numbers, the person possessing the voter registration information may not enhance or supplement the information by acquiring and using those telephone numbers from any other source.
C. Any city, town or county that lawfully provides bulk voter registration information to a person shall inform the person that the secretary of state has established a political "do not call" list and shall provide information on how to use that list. Any city, town or county or other political subdivision that provides information on its public website on how to register to vote shall also inform voters on how to be placed on the political "do not call" list established pursuant to this section.
D. For any voter registration forms printed by this state or any political subdivision of this state after the effective date of this section and if the forms contain sufficient space, the voter registration forms shall include information regarding the secretary of state's "do not call" list established pursuant to this section.
E. A person who attempts to influence the outcome of an election for any political subdivision in this state or who attempts to influence the passage or defeat of state legislation or legislative acts by political subdivisions of this state:
1. May lawfully obtain the telephone numbers on the political "do not call" list and may voluntarily use that information to redact those telephone numbers from the person's call list.
2. Is not subject to the prohibition prescribed by subsection A of this section and is not subject to enforcement action by the secretary of state or the attorney general or any other filing or enforcement officers for any failure to voluntarily redact the telephone numbers.
F. A person who obtains the telephone numbers on the political "do not call" list and who uses those telephone numbers for any purpose other than redaction of a call list is guilty of a class 1 misdemeanor.
