AN ACT
Amending title 20, chapter 4, article 3, Arizona Revised Statutes, by adding section 20-826.05, Arizona Revised Statutes; Amending title 20, chapter 4, article 9, Arizona Revised Statutes, by adding section 20-1057.12; amending title 20, chapter 6, article 4, Arizona Revised Statutes, by adding section 20-1342.06; amending title 20, chapter 6, article 5, Arizona Revised Statutes, by adding sections 20-1402.04 and 20-1404.04; amending title 20, chapter 13, article 1, Arizona Revised Statutes, by adding section 20-2333; relating to cancer medication.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 20, chapter 4, article 3, Arizona Revised Statutes, is amended by adding section 20-826.05, to read:
20-826.05. Oral anticancer medication
A. A contract that is offered by a corporation that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells and that imposes coinsurance for orally administered anticancer medication shall not charge more than four hundred per cent of the contract's tier three prescription drug copayment for orally administered anticancer medication.
B. This section shall not be interpreted to prohibit a health insurer from requiring prior authorization, developing a formulary or imposing other appropriate utilization controls in approving coverage for any chemotherapy.
C. This section does not apply to limited benefit coverage as defined in section 20-1137.
Sec. 2. Title 20, chapter 4, article 9, Arizona Revised Statutes, is amended by adding section 20-1057.12, to read:
20-1057.12. Oral anticancer medication
A. A contract or evidence of coverage that is offered by a health care services organization that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells and that imposes coinsurance for orally administered anticancer medication shall not charge more than four hundred per cent of the contract's or evidence of coverage's tier three prescription drug copayment for orally administered anticancer medication.
B. This section shall not be interpreted to prohibit a health insurer from requiring prior authorization, developing a formulary or imposing other appropriate utilization controls in approving coverage for any chemotherapy.
C. This section does not apply to limited benefit coverage as defined in section 20-1137.
Sec. 3. Title 20, chapter 6, article 4, Arizona Revised Statutes, is amended by adding section 20-1342.06, to read:
20-1342.06. Oral anticancer medication
A. A policy that is offered by a disability insurer that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells and that imposes coinsurance for orally administered anticancer medication shall not charge more than four hundred per cent of the policy's tier three prescription drug copayment for orally administered anticancer medication.
B. This section shall not be interpreted to prohibit a health insurer from requiring prior authorization, developing a formulary or imposing other appropriate utilization controls in approving coverage for any chemotherapy.
C. This section does not apply to limited benefit coverage as defined in section 20-1137.
Sec. 4. Title 20, chapter 6, article 5, Arizona Revised Statutes, is amended by adding sections 20-1402.04 and 20-1404.04, to read:
20-1402.04. Oral anticancer medication
A. A group disability policy that is offered by a group disability insurer that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells and that imposes coinsurance for orally administered anticancer medication shall not charge more than four hundred per cent of the group disability policy's tier three prescription drug copayment for orally administered anticancer medication.
B. This section shall not be interpreted to prohibit a health insurer from requiring prior authorization, developing a formulary or imposing other appropriate utilization controls in approving coverage for any chemotherapy.
C. This section does not apply to limited benefit coverage as defined in section 20-1137.
20-1404.04. Oral anticancer medication
A. A policy or contract that is offered by a blanket disability insurer that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells and that imposes coinsurance for orally administered anticancer medication shall not charge more than four hundred per cent of the policy's or contract's tier three prescription drug copayment for orally administered anticancer medication.
B. This section shall not be interpreted to prohibit a health insurer from requiring prior authorization, developing a formulary or imposing other appropriate utilization controls in approving coverage for any chemotherapy.
C. This section does not apply to limited benefit coverage as defined in section 20-1137.
Sec. 5. Title 20, chapter 13, article 1, Arizona Revised Statutes, is amended by adding section 20-2333, to read:
20-2333. Oral anticancer medication
A. A health benefits plan that is offered by an accountable health plan that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells and that imposes coinsurance for orally administered anticancer medication shall not charge more than four hundred per cent of the health benefit plan's tier three prescription drug copayment for orally administered anticancer medication.
B. This section shall not be interpreted to prohibit a health insurer from requiring prior authorization, developing a formulary or imposing other appropriate utilization controls in approving coverage for any chemotherapy.
C. This section does not apply to limited benefit coverage as defined in section 20-1137. END_STATUTE
Sec. 6. Applicability
This act applies to policies, contracts and plans that are issued or renewed from and after September 30, 2010.
