SENATE BILL 1248

 

 

 

AN ACT

 

Relating to the dual licensure of certain health care institutions.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Dual licensure; department of health service rules; revision

On or before July 1, 2012, the department of health services shall do the following to eliminate the dual licensing requirements for hospitals that provide organized psychiatric services pursuant to title 36, chapter 4, Arizona Revised Statutes:

1.  Remove all references to hospital licensure from the department's behavioral health service agencies licensure rules.

2.  Revise the department's health care institutions licensing rules to remove references to the behavioral health service agencies licensure rules and add licensing rules for psychiatric services.

3.  Add definitions applicable to psychiatric services to the department's health care institutions licensing rules.

Sec. 2.  Exemption from rule making

For the purposes of this act, the department of health services is exempt from the rule making requirements of title 41, chapter 6, Arizona Revised Statutes, for two years after the effective date of this act.
