AN ACT
ESTABLISHING the joint legislative study committee on canal safety and usage.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Joint legislative study committee on canal safety and usage; membership; report; delayed repeal
A. The joint legislative study committee on canal safety and usage is established consisting of the following members:
1. Three members of the house of representatives who are appointed by the speaker of the house of representatives, not more than two of whom are members of the same political party.
2. Three members of the senate who are appointed by the president of the senate, not more than two of whom are members of the same political party.
3. A representative of an agricultural improvement district who is appointed by the speaker of the house of representatives.
4. A representative of a multi-county water conservation district who is appointed by the president of the senate.
5. A representative of an irrigation district who is appointed by the speaker of the house of representatives.
6. A representative of an organization representing cities and towns in this state who is appointed by the president of the senate.
7. A representative of an organization representing counties in this state who is appointed by the speaker of the house of representatives.
8. A representative of an Indian tribe or nation who is appointed by the president of the senate.
9. Two members of the public with an interest in canal safety, one of whom is appointed by the speaker of the house of representatives and one of whom is appointed by the president of the senate.
10. The director of the department of water resources or the director's designee. The representative of the department of water resources shall serve as a nonvoting advisory member of the committee.
B. The committee shall meet and elect from its members a chairman and a vice-chairman. Members of the committee are not entitled to compensation or to reimbursement of expenses. The committee shall consider all of the following:
1. Identification of affected stakeholders including persons interested in or responsible for canal safety.
2. Identification of safety issues relating to canal usage including the potential for drowning or other personal harm.
3. Identification of current efforts to increase and promote canal safety.
4. Identification of legal issues associated with canal ownership, operation and public and private access including recreational usage of canal banks and related areas.
5. Identification of opportunities to improve canal safety including enhanced educational efforts and public-private and multi-jurisdictional partnerships.
C. The committee shall prepare a draft report of its findings and recommendations no later than December 1, 2012 and shall submit its final report to the speaker of the house of representatives and the president of the senate on or before June 30, 2013 and shall provide a copy of this report to the secretary of state.
D. This section is repealed from and after September 30, 2013.
