AN ACT
Providing for the leasing of marana prison from the Department of administration to the united states government.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Department of administration; lease agreement; Marana prison site; United States government; termination; delayed repeal
A. The department of administration shall lease the Marana prison site to the United States government for $1 per year to house individuals held by the United States government for immigration violations. The lease shall be for an initial term of four years with an option for the United States government to extend the lease for an additional two years. The agreement shall require the United States government to maintain the Marana prison site over the full term of the lease in the same or better condition as received at the beginning of the lease. Any repairs, refurbishments or replacements within the Marana prison site shall be made in accordance with generally accepted industry standards.
B. The lease agreement pursuant to subsection A of this section shall include a provision that allows the department of administration to terminate the lease and take back control of the Marana prison site if both of the following conditions are met:
1. The department of administration provides written notice to the United States government at least twelve months before the department of administration intends to terminate the lease.
2. The department of administration demonstrates that the beds within the Marana prison site are needed to sufficiently house inmates in the custody of this state.
C. This section is repealed from and after September 30, 2032.
