AN ACT

 

amending section 9‑303, Arizona Revised Statutes; amending title 11, chapter 2, article 10, Arizona Revised Statutes, by adding section 11‑352.01; relating to city and county managers.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 9-303, Arizona Revised Statutes, is amended to read:

START_STATUTE9-303.  City or town manager; subject to recall; severance package prohibited; exception

A.  The governing body of a city or town, in addition to the officers already specified by law, may, by ordinance, create the office of city or town manager, and appoint a person thereto to be known as the city or town manager.

B.  The city or town manager shall have and exercise the powers and perform the duties relating to the affairs of the city or town as shall be specified by the ordinance creating the office of city or town manager.

C.  The person appointed to the office of city or town manager shall serve at the pleasure of the governing body of the city or town and may be removed without cause by a majority vote thereof of the governing body.

D.  Notwithstanding subsection C, the contract of any city or town manager who is appointed to that position after the effective date of this amendment to this section shall include a clause that allows the citizens of the jurisdiction to terminate the person as city or town manager if a majority of persons voting on the question approve of the termination at a regularly scheduled general election.  The recall procedure shall be substantially similar to the recall of a public officer.

E.  Any city or town manager who is appointed to that position after the effective date of this amendment to this section is not entitled to receive a severance package on termination of employment from the city or town.

F.  Subsections D and E do not apply if the city or town manager is appointed to that position by the mayor of the city or town. END_STATUTE

Sec. 2.  Title 11, chapter 2, article 10, Arizona Revised Statutes, is amended by adding section 11-352.01, to read:

START_STATUTE11-352.01.  Exempt county manager; subject to recall; severance package prohibited

A.  The contract of any county manager who is exempt from the limited county employee merit system adopted pursuant to section 11‑352 and who is appointed to that position after the effective date of this section shall include a clause that allows the citizens of the jurisdiction to terminate the person as county manager if a majority of persons voting on the question approve of the termination at a regularly scheduled general election.  The recall procedure shall be substantially similar to the recall of a public officer.

B.  Any county manager who is appointed to that position after the effective date of this section is not entitled to receive a severance package on termination of employment from the county. END_STATUTE
