AN ACT
CHANGING THE DESIGNATION OF TITLE 12, CHAPTER 7, ARTICLE 13, Arizona Revised Statutes, TO "LAWS RELATING TO ANIMALS"; amending section 12‑1011, Arizona Revised Statutes; AMENDING TITLE 12, CHAPTER 7, ARTICLE 13, Arizona Revised Statutes, BY ADDING SECTIONs 12‑1012 and 12‑1013; relating to animal cruelty or neglect.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Heading change
The article heading of title 12, chapter 7, article 13, Arizona Revised Statutes, is changed from "LIABILITY FOR ANIMAL RESCUE COSTS" to "LAWS RELATING TO ANIMALS".
Sec. 2. Section 12-1011, Arizona Revised Statutes, is amended to read:
12-1011. Liability for animal rescue costs; copy of conviction transmitted to enforcement authorities
a. An owner is liable to this state or a political subdivision of this state for the expenses incurred by this state or a political subdivision of this state in rescuing animals that belong to the owner if the animals have been cruelly treated or neglected and the owner has been convicted of a violation of section 13-2910.
B. On conviction of a violation of section 13‑2910, bestiality as prescribed in section 13-1411, animal fighting as prescribed in section 13‑2910.01, cockfighting as prescribed in section 13‑2910.03 or equine tripping as defined in section 13‑2910.09, the court shall provide a copy of the minute entry or disposition order to the animal welfare enforcement authority in its jurisdiction.
Sec. 3. Title 12, chapter 7, article 13, Arizona Revised Statutes, is amended by adding sections 12-1012 and 12‑1013, to read:
12-1012. Limitation on animal ownership
On conviction of any violation of section 13‑1411, 13‑2910 or 13‑2910.01 and if the person is placed on supervised or unsupervised probation, the person shall be prohibited from adopting, fostering, owning or otherwise having care or custody of any animal in the person's household during the period of probation.
12-1013. Mandatory reporting of suspected animal cruelty; definition
A. Any person who has evidence that an animal is or has been the victim of cruel mistreatment or cruel neglect as defined in section 13‑2910, bestiality as prescribed in section 13-1411, animal fighting as prescribed in section 13-2910.01, cockfighting as prescribed in section 13‑2910.03 or equine tripping as defined in section 13-2910.09 shall immediately report or cause a report to be made of this information to a peace officer, animal control enforcement officer or a livestock officer.
B. This chapter does not:
1. Prohibit or restrict activities pursuant to title 3.
2. Apply to persons who raise animals for food production or the harvesting of such animals.
C. For the purposes of this section, "person" means:
1. An employee of the department of economic security.
2. An employee of the department of health services.
3. Any public nursing or home health provider.
