An Act
appropriating monies to the Arizona health care cost containment system.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Appropriation; Arizona health care cost containment system administration; institutional and community-based services; exemption; rulemaking exemption
A. The sum of $5,000,000 is appropriated from the state general fund in fiscal year 2024-2025 to the Arizona health care cost containment system to provide institutional services and home and community-based services to individuals who have not been determined eligible for services pursuant to title 36, chapter 29, article 2, Arizona Revised Statutes. The administration may provide services through a program contractor as defined in section 36-2931, Arizona Revised Statutes. An individual may be eligible for services under this section for a period of not more than three months.
B. This section does not establish:
1. An entitlement for any person to receive any particular service.
2. A duty on the administration to provide services or spend monies in excess of the amount of the appropriation made in subsection A of this section.
C. The administration may use up to ten percent of the amount of the appropriation made in subsection A of this section for administrative purposes.
D. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
E. Notwithstanding any other law, for the purposes of this section, the Arizona health care cost containment system is exempt from the rulemaking requirements of title 41, chapter 6, Arizona Revised Statutes, for one year after the effective date of this act.
