A Concurrent Resolution

 

enacting and ordering the submission to the people of a measure relating to local government powers.

Be it resolved by the Senate of the State of Arizona, the House of Representatives concurring:

1. Under the power of the referendum, as vested in the Legislature, the following measure, relating to local government powers, is enacted to become valid as a law if approved by the voters and on proclamation of the Governor:

AN ACT

amending title 9, chapter 2, article 3, Arizona Revised Statutes, by adding section 9-256; amending title 11, chapter 2, article 2, Arizona Revised Statutes, by adding section 11-225; relating to local government powers.

Section 1. Title 9, chapter 2, article 3, Arizona Revised Statutes, is amended by adding section 9-256, to read:

START_STATUTE9-256. Common council; increase in taxes or fees; two-thirds vote requirement; state preemption

A. Notwithstanding any other law, the common council of a municipality may not levy or impose an increase in any assessment, tax or fee without a two-thirds vote of the common council of the municipality.

b. The regulation of increases in municipal assessments, taxes and fes is a matter of statewide concern.  a Municipality's ability to increase assessments, taxes and fees pursuant to the requirements of subsection a of this section is not subject to further regulation by a municipality. Sec. 2. Title 11, chapter 2, article 2, Arizona Revised Statutes, is amended by adding section 11-225, to read:

START_STATUTE11-225. Board of supervisors; increase in taxes or fees; two-thirds vote requirement; state preemption

A. Notwithstanding any other law, the board of supervisors of a county may not levy or impose an increase in any assessment, tax or fee without a two-thirds vote of the board of supervisors of the county.

B. The regulation of increases in county assessments, taxes and fes is a matter of statewide concern. A county's ability to increase assessments, taxes and fees pursuant to the requirements of subsection A of this section is not subject to further regulation by a county. END_STATUTE

2. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article IV, part 1, section 1, Constitution of Arizona.
