SENATE CONCURRENT RESOLUTION 1034

proposing an amendment to the Constitution of Arizona; amending article IV, part 2, section 20, Constitution of Arizona; relating to appropriation bills.

Be it resolved by the Senate of the State of Arizona, the House of Representatives concurring:

1. Article IV, part 2, section 20, Constitution of Arizona, is proposed to be amended as follows if approved by the voters and on proclamation of the Governor:

CONST20. Appropriation bills; continuing appropriation; exception

Section 20. A. The general appropriation bill shall embrace nothing but appropriations for the different departments of the this state, for state institutions, for public schools and for interest on the public debt. All other appropriations shall be made by separate bills, each embracing but one subject.

B. Except as provided in subsection C of this section, if a new fiscal year begins and no general APPROPRIATION bill has been signed into law for that fiscal year, the general appropriation bill in effect for the immediately preceding fiscal year continues in effect as if enacted into law for the new fiscal year until a general appropriation bill has been signed into law for that fiscal year, except that the joint legislative budget committee or its successor agency, by a majority vote of all members appointed to the committee, shall adjust the amounts that were in effect for the immediately preceding fiscal year to remove onetime expenditures and to account for inflation and enrollment growth for programs administered by the department of education, the Arizona health care cost containment system and the department of economic security, or their successor agencies, in the new fiscal year.

C. The general appropriation bill in effect for the immediately preceding fiscal year does not CONTINUE in effect for the new fiscal year if the general appropriation bill in effect for the immediately preceding fiscal year, after being adjusted as required by subsection B of this section, appropriates an amount that exceeds the projected general fund revenues for the new fiscal year.

D. The legislature shall enact laws to enforce this section. CONST

2. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
