BILL NUMBER: AB 1148 INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Melendez FEBRUARY 22, 2013 An act to amend Section 12022.55 of the Penal Code, relating to crimes. LEGISLATIVE COUNSEL'S DIGEST AB 1148, as introduced, Melendez. Crimes: sentence enhancements. Existing law requires any person who, with the intent to inflict great bodily injury or death, inflicts great bodily injury, as defined, or causes the death of a person, other than an occupant of a motor vehicle, as a result of discharging a firearm from a motor vehicle in the commission of a felony or attempted felony, be punished by an additional and consecutive term of imprisonment in the state prison for 5, 6, or 10 years. This bill would make a technical, nonsubstantive change to that provision. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 12022.55 of the Penal Code is amended to read: 12022.55. Notwithstanding Section 12022.5,anya person who, with the intent to inflict great bodily injury or death, inflicts great bodily injury, as defined in Section 12022.7, or causes the death of a person, other than an occupant of a motor vehicle, as a result of discharging a firearm from a motor vehicle in the commission of a felony or attempted felony, shall be punished by an additional and consecutive term of imprisonment in the state prison for 5, 6, or 10 years.
