   An act to amend Section 788 of the Insurance Code, relating to
insurance.



	LEGISLATIVE COUNSEL'S DIGEST


   AB 1262, as introduced, Hagman. Insurance: disability insurance:
seniors.
   Existing law prohibits an insurer from knowingly recommending for
sale or selling disability insurance providing health benefits
directly to a Medi-Cal beneficiary who is age 65 or older. Existing
law requires, when selling disability insurance providing health
benefits to a person age 65 or older, to include in the application
or other supplemental record signed by the applicant a question
designed to determine if the applicant is receiving Medi-Cal
benefits.
   This bill would make technical, nonsubstantive changes to these
provisions.
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 788 of the Insurance Code is amended to read:
   788.  An insurer, agent, broker, or other person engaged in the
transaction of insurance shall not knowingly recommend for sale, or
sell, disability insurance providing health benefits directly to a
Medi-Cal beneficiary who is  age  65  years of
age  or older. For disability insurance providing health
benefits sold to a person  age  65  years of age
 or older, the application or other supplemental record signed
by the applicant shall contain a question designed to determine if
the applicant is receiving Medi-Cal benefits.
