BILL NUMBER: AB 1281 INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Wilk (Coauthor: Assembly Member Gallagher) FEBRUARY 27, 2015 An act to add Section 11346.01 to the Government Code, relating to regulations. LEGISLATIVE COUNSEL'S DIGEST AB 1281, as introduced, Wilk. Regulations: legislative review. The Administrative Procedure Act governs the procedure for the adoption, amendment, or repeal of regulations by state agencies and for the review of those regulatory actions by the Office of Administrative Law. This bill, whenever 25% of the Members of the Assembly or Senate transmit to the Governor their written declaration of opposition to a proposed regulation, would require a majority vote of the Assembly and Senate to adopt that regulation. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 11346.01 is added to the Government Code, to read: 11346.01. Notwithstanding any other law, when 25 percent of the Members of the Assembly or Senate transmit to the Governor their written declaration of opposition to a proposed regulation, adoption of the regulation shall require a majority vote of the Assembly and Senate.
