   An act to add Section 3007.5 to the Penal Code, relating to
parolees.



	LEGISLATIVE COUNSEL'S DIGEST


   AB 1577, as introduced, Atkins. Parolee: driver's licenses.
   Existing law authorizes the Department of Motor Vehicles to
require a person applying for a driver's license or an identification
card to provide any identification that it determines is necessary
to ensure the identity of the applicant.
   This bill would authorize the Department of Corrections and
Rehabilitation or county jails to provide an offender with a parolee
identification card and would require the Department of Motor
Vehicles to honor that card as a valid source of identification for
the purposes of applying for a driver's license or an identification
card.
   The bill would require the above-referenced departments and county
jails to adopt rules and enter into interagency agreements necessary
to establish the identities of offenders for the purposes of
assisting offenders in obtaining a driver's license or identification
card immediately upon the offender's release. The bill would specify
that its provisions are not intended to abrogate any requirement set
forth in the Vehicle Code. By requiring counties to adopt rules and
enter into agreements to expand services to prisoners, this bill
would impose a state-mandated local program.
   The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that
reimbursement.
   This bill would provide that, if the Commission on State Mandates
determines that the bill contains costs mandated by the state,
reimbursement for those costs shall be made pursuant to these
statutory provisions.
   Vote: majority. Appropriation: no. Fiscal committee: yes.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 3007.5 is added to the Penal Code, to read:
   3007.5.  (a) The Department of Motor Vehicles, the Department of
Corrections and Rehabilitation, and county jails shall adopt rules
and enter into interagency agreements necessary to establish the
identity of an offender for the purpose of assisting the offender in
obtaining a driver's license or identification card immediately upon
the offender's release from an institution of the Department of
Corrections and Rehabilitation or a county jail.
   (b) The Department of Corrections and Rehabilitation or a county
jail may provide an offender a parolee identification card that shall
be honored by the Department of Motor Vehicles as a valid source of
identification for the purposes of applying for a driver's license or
an identification card.
   (c) Nothing in this section is intended to abrogate any
requirement set forth in the Vehicle Code.
  SEC. 2.  If the Commission on State Mandates determines that this
act contains costs mandated by the state, reimbursement to local
agencies and school districts for those costs shall be made pursuant
to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of
the Government Code.
