    An act relating to state property.   An act
to add Section 5161.5 to the Public Resources Code, relating to state
parks. 



	LEGISLATIVE COUNSEL'S DIGEST


   AB 1825, as amended, Garrick. State  property: 
 parks:  "Save the Ocean" mosaic.
   Existing law provides that the right to all property within the
state is in the people. Existing law provides for the regulation of
designated state parks by the Department of Parks and Recreation.

   This bill would declare the intent of the Legislature to enact
legislation that would authorize placement of the "Save the Ocean"
mosaic in a state park located in Encinitas, California. 

   This bill would authorize the governing body of the City of
Encinitas to authorize the placement of a "Save the Ocean" mosaic in
a state park located in Encinitas, California, subject to private
funding, as specified. The bill would not require the mosaic to
receive approval by the Department of Parks and Recreation. 
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 5161.5 is added to the 
 Public Resources Code   , to read:  
   5161.5.  Notwithstanding any other provision of law, the governing
body of the City of Encinitas may authorize the placement of a "Save
the Ocean" mosaic in the state park located at the corner of Highway
101 and B Street in Encinitas, California, if the mosaic is donated
to the city, and the construction, placement, and maintenance of the
mosaic are funded using private donations. The construction,
placement, and maintenance of the mosaic do not require approval by
the Department of Parks and Recreation.  
  SECTION 1.    It is the intent of the Legislature
to enact legislation that would authorize placement of the "Save the
Ocean" mosaic in the state park located at the corner of Highway 101
and B Street in Encinitas, California.
