   An act to amend Section 9070 of, and to add Section 9075.5 to, the
Government Code, relating to legislative records.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 1946, as introduced, Grove. Legislative Open Records Act.
   The Legislative Open Records Act (LORA) requires that a
legislative record, as defined, be open to public inspection unless
the record is exempt from disclosure under the act.
   This bill would provide that LORA shall be construed with a strong
presumption in favor of public access to legislative records. The
bill would state that a record that reflects the approved budget
allocation for a Member of the Legislature or the Member's office is
not exempt from mandatory disclosure under LORA.
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 9070 of the Government Code is amended to read:

   9070.   (a)    The Legislature finds and
declares that access to information concerning the conduct of the
people's business by the Legislature is a fundamental and necessary
right of every citizen in this state. 
   (b) This article shall be construed with a strong presumption in
favor of public access to legislative records. 
  SEC. 2.  Section 9075.5 is added to the Government Code, to read:
   9075.5.  Nothing in this article shall be deemed to exempt from
mandatory disclosure a record that reflects the approved budget
allocation for a Member of the Legislature or the Member's office.
