   An act to amend Section 1011 of the Military and Veterans Code,
relating to veterans.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 2309, as amended, Fletcher.  Veterans'  
Veterans  Home of California.
   Existing law  provides for the establishment and operation
of the Veterans' Home of California at various sites, and declares
  specifies  that there is in the Department of
Veterans Affairs a  Veterans'   Veterans 
Home of California, Yountville  , and that the department may
establish and construct a second veterans home located on one or more
sites in specified counties. Existing law specifies the particular
sites of the second home  .
   This bill would  update that provision to declare that
additionally there are in the department a Veterans' Home of
California, Barstow, a Veterans' Home of California, Chula Vista, a
Veterans' Home of California, Lancaster, and a Veterans' Home of
California, Ventura   revise and recast these provisions
to state, in the same order as listed in current law, that there is
a veterans home at Yountville and at each of the locations currently
specified as a site of the second home  . This bill would
provide for the  Veterans'   Veterans  Home
of California, Chula Vista, to also be known as the "John Smith
Memorial  Veterans'   Veterans  Home," and
 for  the Veterans Home of California, Lancaster, to also be
known as the "William J. 'Pete' Knight  Veterans' 
 Veterans  Home."  This bill would authorize the
department to complete any preapplication process necessary with the
United States Department of Veterans Affairs for construction of the
homes.  
   This bill would also make other conforming changes.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 1011 of the Military and Veterans Code is
amended to read: 
   1011.  (a) There is in the department a Veterans' Home of
California, Yountville, situated in Napa County.
   (b) There is in the department a Veterans' Home of California,
Barstow, situated in San Bernardino County.
   (c) There is in the department a Veterans' Home of California,
Chula Vista, situated in San Diego County. This veterans' home shall
also be known as the "John Smith Memorial Veterans' Home."
   (d) There is in the department a Veterans' Home of California,
Lancaster, situated in Los Angeles County. This veterans' home shall
also be known as the "William J. 'Pete' Knight Veterans Home."
   (e) There is in the department a Veterans' Home of California,
Ventura, situated in Ventura County. 
    1011.   (a) There is in the department all of the
following:  
   (1) A Veterans Home of California, Yountville, situated in Napa
County.  
   (2) A Veterans Home of California, Barstow, situated in San
Bernardino County.  
   (3) A Veterans Home of California, Chula Vista, situated in San
Diego County. This veterans home shall also be known as the "John
Smith Memorial Veterans Home."  
   (4) A Veterans Home of California, Lancaster, situated in Los
Angeles County. This veterans home shall also be known as the
"William J. 'Pete' Knight Veterans Home."  
   (5) A Veterans Home of California, Ventura, situated in Ventura
County.  
   (6)  A Veterans Home of California, West Los Angeles, situated in
Los Angeles County.  
   (f) 
    (b)  The department may complete any preapplication
process necessary with the United States Department of Veterans
Affairs for construction of the homes. 
   (g) 
    (c)  The Legislature hereby finds and declares that the
homes are a new state function. The department may perform any or all
work in operating the homes by independent contractors, except the
overall administration and management of the homes. Any and all
actions of the department taken before September 17, 1996, that are
consistent with this subdivision are hereby ratified and confirmed,
it having at all times been the intent of the Legislature that the
department be so authorized. 
   (h) 
    (d)  There shall be an administrator for each home or
homesite, who shall be recommended by the Secretary of Veterans
Affairs and appointed by the Governor, and shall be located at that
home or homesite. The salary for each administrator shall be subject
to the approval of the Department of Personnel Administration.
