An act to add Section 43018.1 to the Health and Safety Code, relating to vehicular air pollution.

AB 2365, as amended, Acosta.
Vehicular air pollution: emissions standards: exemption.
Existing law requires the State Air Resources Board to achieve the maximum degree of emission reduction possible from vehicular and other mobile sources to accomplish the attainment of the state standards at the earliest practicable date.
This bill would exempt exempt, except as specified, from any regulation requiring the installation of air pollution control technology the engines used to power a crane of any size that is part of a fleet of 25 or less cranes.

The people of the State of California do enact as follows:
SECTION 1.
Section 43018.1 is added to the Health and Safety Code, to read:43018.1.
(b) (1) The exemption provided for in subdivision (a) shall not apply to a new owner or transferee of a crane whose engines previously qualified for the exemption provided for in subdivision (a).
(2) Upon the sale or transfer of a crane subject to this section, the seller or transferor shall notify the state board.
