Home energy rating service providers: data: compliance document repository.
Existing law requires the State Energy Resources Conservation and Development Commission to serve as a central repository for the collection, storage, retrieval, and dissemination of data and information on all forms of energy supply, demand, conservation, public safety, research, and related subjects. Existing law requires the commission to adopt a statewide home energy rating program for residential dwellings. Under existing law, the commission adopted regulations that require home energy rating system providers to record and maintain for a period of 10 years all data collected for a rating, as provided, and require the provider, upon request by the commission, to submit the data to the commission and provide the commission ongoing access to the database.
This bill would require the commission to establish a compliance document repository and
would require home energy rating system providers to transmit all the data required to be recorded and maintained to the repository. The bill would require the commission to make information in the repository available to the public only in aggregate form and would prohibit the disclosure of personally identifiable information.

The people of the State of California do enact as follows:
SECTION 1.
Section 25216.7 is added to the Public Resources Code, to read:25216.7.
(a) To enable the commission to determine the efficacy of regulations adopted under subdivision (a) or (b) of Section 25402 and intended to reduce the wasteful, uneconomic, inefficient, or unnecessary consumption of energy, including the energy associated with water, the commission shall establish a compliance document repository to maintain data transmitted by home energy rating system providers under subdivision (b).(b) Each home energy rating system provider shall transmit to the commission all data from its database containing information recorded and maintained pursuant to subdivision (e) of Section 1673 of Title 20 of the California Code of Regulations or any successor regulation.
(c) The commission shall make the information in the repository available in the public only in aggregate form and shall not disclose to the public any personally identifiable information unless required by law.
