   An act relating to state property.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 495, as amended, Logue. State property: Harts Mill Forest Fire
Station: transfer.
   Existing law authorizes the Director of General Services to
execute grants to real property belonging to the state in the name
and upon behalf of the state, whenever the sale or exchange of real
property is authorized or contemplated by law, if no other state
agency is specifically authorized and directed to execute the grants.

   This bill would authorize the  director  
Director of General Services  to transfer state property, known
as the Harts Mill Forest Fire Station (Old), to the County of Butte,
as prescribed.  This   If the property is
transferred, the  bill would  also  require the
County of Butte to  use   maintain  the
property  in perpetuity  for parks and open-space purposes.

   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  (a) Notwithstanding any other law, the Director of
General Services may transfer to the County of Butte state property
that consists of approximately 2.76 acres, known as the Harts Mill
Forest Fire Station (Old), located at 9476 Oro-Quincy Highway, in
Berry Creek,  Butte  County  of Butte  .
   (b) If the property is transferred pursuant to this section,
including the requirements in subdivision (c), the County of Butte
shall be responsible for reimbursing the Department of General
Services for the reasonable costs incurred by the department in
performing the transfer. 
   (c) The Department of General Services shall determine what, if
any, remediation of the property is required, and shall require that
remediation to be performed prior to any transfer pursuant to this
section.  
   (d) 
    (c)    As a condition of receiving the
property, the County of Butte shall accept the property as is, and
shall maintain the property in perpetuity for parks and open-space
purposes within the meaning of paragraph (4) of subdivision (c) of
Section 11011.1 of the Government Code. Notwithstanding any other law
that limits reversionary rights to real property, including, but not
limited to, Chapter 5 (commencing with Section 885.010) of Title 5
of Part 2 of Division 2 of the Civil Code, title to this property
shall revert to the possession, control, and ownership of the state
if the condition in this subdivision is violated. 
   (e) The Legislature reaffirms that the transfer of property
pursuant to this section shall be subject to the requirements in
paragraph (1) of subdivision (k) of Section 11011 of the Government
Code, and shall be eligible for transfer pursuant to Section 11011.1
of the Government Code.
