An act to amend Section 25000 25150 of the Government Code, relating to local government.

AB 799, as amended, Mathis. Counties: board of supervisors.
The California Constitution provides that the state is divided into counties, which are legal subdivisions, and requires, among other things, that the Legislature provide for an elected governing body in each county. Existing law implementing this requirement requires that each county have a board of supervisors consisting of 5 members, of which no more than 3 may be elected at the same general election. members. Existing law requires the board of supervisors to, within 10 days after each session, publish a fair statement of all its proceedings, except as provided.

This bill would make nonsubstantive changes to these provisions.

This bill would, instead, require the board of supervisors to, within 7 days after each session, publish a fair statement of all its proceedings, except as provided.

The people of the State of California do enact as follows:


SECTION 1.

 Section 25150 of the Government Code is amended to read:

25150.
 (a) Except as otherwise provided in subdivision (b), within 10 seven days after each session of the board of supervisors, it shall cause to be published a fair statement of all its proceedings.
(b) In lieu of the requirements imposed by subdivision (a), the board of supervisors may provide copies of agendas and summaries of proceedings to every newspaper, radio and television station, and library in the county, and to any other person who requests such information.

SECTION 1.Section 25000 of the Government Code is amended to read:
25000.

(a)Each county shall have a board of supervisors consisting of five members. Not more than three members shall be elected at the same general election. If the terms of office of more than three members of the board expire at the same time, at the first regular meeting after January 1 following their election, the members elected shall classify themselves by lot that three members shall serve for four years, and two for two years. Thereafter, the term of office of each member shall be four years.

(b)Notwithstanding any other law, the board of supervisors of any general law or charter county may adopt or the residents of the county may propose, by initiative, a proposal to limit or repeal a limit on the number of terms a member of the board of supervisors may serve on the board of supervisors. Any proposal to limit the number of terms a member of the board of supervisors may serve on the board of supervisors shall apply prospectively only and shall not become operative unless it is submitted to the electors of the county at a regularly scheduled election and a majority of the votes cast on the question favor the adoption of the proposal.
