An act to add Section 14132.14 to the Welfare and Institutions Code, relating to Medi-Cal.

Medi-Cal: Early and Periodic Screening, Diagnosis, and Treatment.
Existing law provides for the Medi-Cal program, which is administered by the State Department of Health Care Services, under which qualified low-income individuals receive healthcare services. health care services, including Early and Periodic Screening, Diagnosis, and Treatment (EPSDT) services, such as screening services, vision services, and other necessary services to correct or ameliorate defects and physical and mental illnesses and conditions discovered by the screening services, whether or not the services are covered under the state plan, for any individual under 21 years of age. The Medi-Cal program is, in part, governed and funded by federal Medicaid Program provisions. Existing law provides that Early and Periodic Screening, Diagnosis, and Treatment (EPSDT) services for any individual under 21 years of age is covered under Medi-Cal consistent with the requirements of federal law. Under federal law, EPSDT services include screening services, vision services, dental services, hearing services, and other necessary services to correct or ameliorate defects and physical and mental illnesses and conditions discovered by the screening services, whether or not the services are covered under the state plan.
Existing law establishes the California State Auditor’s Office, headed by the California State Auditor and under the direction of the Milton Marks “Little Hoover” Commission on California State Government Organization and Economy, with specified duties, which include, upon the request by the Joint Legislative Audit Committee and to the extent funding is available, auditing a state or local governmental agency or any other publicly created entity. Existing law requires any entity that is audited or investigated by the California State Auditor to provide updates on its progress in implementing the recommendations made by the California State Auditor.
This bill would declare the
intent of the Legislature to enact legislation to ensure that children enrolled in the Medi-Cal program receive timely access to care and preventative care services, based upon the findings of the California State Auditor, as specified. require the department to conduct a review of a report published by the California State Auditor concerning EPSDT services, to develop and publish a report on the department’s findings and response, and to solicit comments from the public regarding the department’s report.

The people of the State of California do enact as follows:
SECTION 1.
Section 14132.14 is added to the Welfare and Institutions Code, immediately following Section 14132.108, to read:14132.14.
(a) For purposes of ensuring that children enrolled in the Medi-Cal program receive timely access to Early and Periodic Screening, Diagnosis, and Treatment services for which they are eligible, the department shall conduct a review of the California State Auditor’s Report 2018-111, entitled “Children in Medi-Cal: Access to Care and Preventative Services.(b) Upon completion of the review, the department shall develop a report on its findings and response, publish the report, and solicit comments from the public concerning the report.
It is the intent of the Legislature to enact legislation to ensure that children enrolled in the Medi-Cal program receive timely access to Early and Periodic Screening, Diagnosis, and Treatment services for which they are eligible, based upon the findings of the California State Auditor’s Report 2018-111, entitled “Children in Medi-Cal: Access to Care and Preventative Services.”
