BILL NUMBER: SB 1043 AMENDED BILL TEXT AMENDED IN ASSEMBLY AUGUST 22, 2012 INTRODUCED BY Committee on Budget and Fiscal Review FEBRUARY 6, 2012 An actrelating to the Budget Act of 2012to amend Section 30028.1 of the Government Code, and to amend Section 17602.1 of the Welfare and Institutions Code, relating to criminal justice realignment, and making an appropriation therefor, to take effect immediately, bill related to the budget . Existing law, commencing with the 2012-13 fiscal year, requires the Controller to allocate 96.015% of the funds allocated to the Juvenile Justice Subaccount from the Local Revenue Fund 2011 to the Youthful Offender Block Grant Special Account, and to allocate 3.085% of the funds in that subaccount to the Juvenile Reentry Grant Special Account, as specified. This bill would instead require the Controller to allocate 94.481% of the funds described above to the Youthful Offender Block Grant Special Account, and to allocate 5.519% to the Juvenile Reentry Grant Special Account. Existing law requires the Controller to allocate to the CalWORKs Maintenance of Effort Subaccount of each local health and welfare trust fund the amounts deposited and remaining unexpended and unreserved in the Maintenance of Effort Subaccount on the 15th day of each month. This bill would instead require the Controller to allocate to the CalWORKs Maintenance of Effort Subaccount of each local health and welfare trust fund the amounts deposited into the Maintenance of Effort Subaccount. The bill would also make a $1,000 appropriation from the General Fund to the Department of Corrections and Rehabilitation, as specified. This bill would declare that it is to take effect immediately as a bill providing for appropriations related to the Budget Bill.This bill would express the intent of the Legislature to enact statutory changes relating to the Budget Act of 2012.Vote: majority. Appropriation:noyes . Fiscal committee:noyes . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. This act shall be known and may be cited as 2011 Realignment Legislation. SEC. 2. Section 30028.1 of the Government Code is amended to read: 30028.1. Commencing with the 2012-13 fiscal year, funds allocated to the Juvenile Justice Subaccount from the Local Revenue Fund 2011 pursuant to paragraph (4) of subdivision (e) of Section 30027.5, paragraph (4) of subdivision (e) of Section 30027.6, paragraph (4) of subdivision (e) of Section 30027.7, and paragraph (4) of subdivision (e) of Section 30027.8 shall be allocated by the Controller as follows: (a) To the Youthful Offender Block Grant Special Account:96.01594.481 percent. (b) To the Juvenile Reentry Grant Special Account:3.0855.519 percent. SEC. 3. Section 17602.1 of the Welfare and Institutions Code is amended to read: 17602.1. On or before the 27th day of each month, the Controller shall allocate, pursuant to a schedule prepared by the Department of Finance, to the CalWORKs Maintenance of Effort Subaccount of each local health and welfare trust fund the amounts depositedand remaining unexpended and unreserved on the 15th day of the month ininto the CalWORKs Maintenance of Effort Subaccount. SEC. 4. There is hereby appropriated one thousand dollars ($1,000) from the General Fund to the Department of Corrections and Rehabilitation for administrative operations. SEC. 5. This act is a bill providing for appropriations related to the Budget Bill within the meaning of subdivision (e) of Section 12 of Article IV of the California Constitution, has been identified as related to the budget in the Budget Bill, and shall take effect immediately.SECTION 1.It is the intent of the Legislature to enact statutory changes relating to the Budget Act of 2012.
