An act to add Section 47634.3 to the Education Code, relating to pupil instruction.

The Charter Schools Act of 1992 authorizes the establishment, operation, and governance of charter schools. Existing law authorizes a charter school to receive funding for nonclassroom-based instruction only if a determination for funding is made by the State Board of Education, as specified.
Existing law authorizes a local educational agency, including a charter school, to offer independent study to meet the educational needs of pupils in accordance with certain requirements, as provided.
This bill would require the state board to convene a workgroup composed of specified representatives to discuss nonclassroom-based instruction at charter schools and propose recommended updates and revisions to the state board on the
determination of funding process and the requirements for educational opportunities offered by a local educational agency through independent study.
The bill would require the workgroup, on or before June 30, 2025, to submit to the state board recommendations for any statutory or regulatory changes the workgroup deems advisable, and would require the state board, on or before September 30, 2025, to consider the recommendations of the workgroup and initiate the rulemaking process for any regulatory revisions the state board finds necessary.
Existing law authorizes a school district, charter school, or county office of education to provide independent study courses for pupils enrolled in kindergarten and grades 1 to 12, inclusive, in accordance with prescribed conditions.
This bill would state the intent of the Legislature to enact future legislation that is related to independent study courses, including those at nonclassroom-based charter schools.

The people of the State of California do enact as follows:
SECTION 1.
Section 47634.3 is added to the Education Code, to read:47634.3.
(a) The state board shall convene a workgroup to discuss nonclassroom-based instruction at charter schools and propose recommended updates and revisions to the state board on both of the following:(1) The process the state board uses, pursuant to Section 47634.2, in making a determination of funding for nonclassroom-based instruction at a charter school.
(2) The requirements, pursuant to Article 5.5 (commencing with Section 51744) of Chapter 5 of Part 28, for educational opportunities offered by a local educational agency through independent study.
(b) The workgroup shall include representatives from all of the
following:
(1) The state board.
(2) The state board’s Advisory Commission on Charter Schools.
(3) The department.
(4) The California Consortium for Independent Study.
(5) Nonclassroom-based charter school operators.
(6) Charter management organizations.
(7) Charter support organizations.
(8) School district and county office of education chartering authorities.
(c) (1) The workgroup shall meet at a time and
frequency determined by the state board.
(2) On or before June 30, 2025, the workgroup shall submit to the state board recommendations for any statutory or regulatory changes the workgroup deems advisable.
(3) On or before September 30, 2025, the state board shall consider the recommendations of the workgroup and initiate the rulemaking process for any regulatory revisions the state board finds necessary.
It is the intent of the Legislature to enact future legislation that is related to independent study courses, including those at nonclassroom-based charter schools.
