CALIFORNIA LEGISLATURE— 2025–2026 REGULAR SESSION

Senate Bill
No. 495

Introduced by Senator Allen

February 19, 2025

An act to amend Section 2030 of the Insurance Code, relating to fire insurance.

LEGISLATIVE COUNSEL'S DIGEST

SB 495, as introduced, Allen. Fire insurance.
Existing law generally regulates classes of insurance, including fire insurance. Existing law authorizes an insurer to rescind a fire insurance policy if an alteration in the use or condition of the insured property that is within the control of the insured and is made without the insurer’s consent increases the risk of loss.
This bill would make technical, nonsubstantive changes to that provision.
Vote: MAJORITY   Appropriation: NO   Fiscal Committee: NO   Local Program: NO

The people of the State of California do enact as follows:

SECTION 1.

Section 2030 of the Insurance Code is amended to read:

2030.
An insurer is entitled to rescind a contract of fire insurance upon an alteration in the use or condition of the subject matter insured from that to which it is limited by the policy, when such if that alteration is made without the consent of the insurer by means within the control of the insured, and increases the risk.
