   An act to add Section 7401.5 to the Business and Professions Code,
relating to barbering and cosmetology.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 549, Correa. Barbering and cosmetology.
   Under existing law, the Barbering and Cosmetology Act, the State
Board of Barbering and Cosmetology licenses and regulates persons
engaged in the practice of barbering and cosmetology. Existing law
also requires an establishment in which barbering and cosmetology is
practiced to be licensed by the board.
   This bill would authorize applicants for a license issued by the
board, and board licensees to report gender, language preference, and
ethnicity information, as specified, in initial applications for
licensure and in license renewal forms. The bill would also authorize
applicants for an establishment license and establishment licensees
to report this same information in the same manner. The bill would
further require the board to compile this information quarterly and,
subject to specified limitations, to post it on the board's Internet
Web site. The bill would require the initial application and license
renewal forms to state, among other things, that reporting this
information is voluntary and no adverse action shall be taken against
an applicant or licensee that does not report this information. The
bill would declare the intent of the Legislature in this regard.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  (a) It is the intent of the Legislature to collect
information on gender, language preference, and ethnicity of all
licensees of the State Board of Barbering and Cosmetology, including
establishment licensees.
   (b) Collecting data on the gender, language preference, and
ethnicity of establishment licensees and board licensees will help
ensure that appropriate health and safety information is effectively
provided to affected licensees.
  SEC. 2.  Section 7401.5 is added to the Business and Professions
Code, to read:
   7401.5.  (a) Any applicant for a license issued by the board and a
licensee of the board may report information to the board, in his or
her initial application for a license and in license renewal forms,
and the board shall collect that information reported, regarding the
applicant's or licensee's gender, language preference, and ethnicity.

   (b) An applicant for an establishment license and an establishment
licensee may report information to the board, in his or her initial
application for a license and in license renewal forms, and the board
shall collect that information reported, regarding the applicant's
and licensee's gender, language preference, and ethnicity.
   (c) The information collected by the board pursuant to this
section shall be compiled quarterly and posted on the board's
Internet Web site. The board shall keep the information collected
confidential and shall only post that information collected in a
manner that does not identify individual applicants and licensees.
   (d) The board, in an initial application for licensure or in a
form for license renewal, shall state in a conspicuous manner that
reporting information regarding gender, language preference, and
ethnicity is voluntary, is not a condition of licensure or license
renewal, and that no adverse action shall be taken against any
applicant or licensee that does not report this information.
