BILL NUMBER: SB 723 INTRODUCED BILL TEXT INTRODUCED BY Senator DeSaulnier FEBRUARY 27, 2009 An act to amend Section 42477 of the Public Resources Code, relating to electronic waste. LEGISLATIVE COUNSEL'S DIGEST SB 723, as introduced, DeSaulnier. Electronic waste recovery payments. Existing law requires the Integrated Waste Management Board, in collaboration with the Department of Toxic Substances Control, to establish on July 1, every two years, an electronic waste recovery payment schedule to cover the net cost of an authorized collector in operating a free and convenient system for collecting, consolidating, and transporting covered electronic wastes. Existing law requires the board to make those payments, as specified. This bill would instead require that the board, in collaboration with the department, establish an electronic waste recovery payment schedule to cover the net cost of an authorized collector on July 1 of every year. The bill would also delete an obsolete provision. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 42477 of the Public Resources Code is amended to read: 42477. (a) On July 1, 2004, or as specified otherwise in Section 25214.10.1 of the Health and Safety Code, and on July 1every two years thereafterof every year , the board in collaboration with the department shall establish an electronic waste recovery payment schedule for covered electronic wastes generated in this state to cover the net cost for an authorized collector to operate a free and convenient system for collecting, consolidating , and transporting covered electronic wastes generated in this state. (b) The board shall make the electronic waste recovery payments either directly to an authorized collector or to a covered electronic waste recycler for payment to an authorized collector pursuant to this article.
