An act to add Article 8 (commencing with Section 12100.75) to Chapter 1.6 of Part 2 of Division 3 of Title 2 Chapter 4 (commencing with Section 99540) to Title 20 of the Government Code, relating to state government.

SB 738, as amended, Hueso. Initiative for Californians Abroad in Mexico City, Mexico. Abroad.
Existing law requires the Governor’s Office of Business and Economic Development (GO-Biz) to develop and implement an International Trade and Investment Program and authorizes the Director of GO-Biz to establish international trade and investment offices, as specified.
Existing law requires that the Lieutenant Governor serve as the chair of the International Affairs and Trade Interagency Committee, which shall create a California Trade and Service Office Advisory Group. Existing law specifies that the advisory group, consisting of private sector and nongovernmental leaders, shall explore and identify the use of nonstate funds to open and support offices promoting California trade and services globally.
This bill would require the Initiative for Californians Abroad in Mexico City, Mexico to be established in GO-Biz. The bill would require the office to serve, for purposes of the initiative, as the direct point of contact for Mexican entities on matters relating to California. The bill would require would, at the request of GO-Biz, authorize the Lieutenant Governor Governor, the California Community College Chancellor’s office, the California State University, and the Regents of the University of California to assist the Director of GO-Biz in establishing the initiative in consultation with the Regents of the University of California. The bill would also require the Lieutenant Governor to assist the director in establishing, as part of the initiative, a Mexico International Trade and Investment Program. initiative. The bill would specify the programs and services that the initiative may provide and require authorize the director to create an advisory board composed of 8 individuals who will oversee to provide guidance with respect to overseeing the program and create creating a strategy for using metrics to evaluate the success of the program. The bill would specify that the costs of implementation are to be supported through private contributions. public and private sector moneys. The bill would require GO-Biz to annually report on its activities on the commission’s internet website within 90 days following the close of the fiscal year, including outcomes of those activities and current and emerging issues impacting the California and Mexico relationship.

The people of the State of California do enact as follows:


SECTION 1.

 It is the intent of the Legislature that the Initiative for Californians Abroad serve as a model for the establishment of California service centers in other countries where a significant number of Californians travel or live full or part time.
SECTION 1.Article 8 (commencing with Section 12100.75) is added to Chapter 1.6 of Part 2 of Division 3 of Title 2 of the Government Code, to read:

SEC. 2.

 Chapter 4 (commencing with Section 99540) is added to Title 20 of the Government Code, to read:
CHAPTER  4. The Initiative for Californians Abroad

99540.
 (a) The Initiative for Californians Abroad in Mexico City, Mexico shall be established in the Governor’s Office of Business and Economic Development. For purposes of the initiative, the Governor’s Office of Business and Economic Development shall serve as the direct point of contact for Mexican entities on matters relating to California. (b) The Lieutenant Governor shall At the request of the Governor’s Office of Business and Economic Development, the Lieutenant Governor, the California Community College Chancellor’s office, the California State University, and the Regents of the University of California may assist the Director of the Governor’s Office of Business and Economic Development in establishing the initiative in consultation with the Regents of the University of California. The Lieutenant Governor shall also assist the director in establishing, as part of the initiative, the Mexico International Trade and Investment Program. initiative.
(c) The objective of the initiative shall be to achieve further California’s interest in Mexico. In meeting this objective, the initiative shall do all of the following:
(1) Further California’s interests and values in Mexico. Establish a Mexico International Trade and Investment Program.
(2) Increase access to California services for California residents and organizations present in Mexico.
(3) Implement Support the implementation of memoranda of understanding between California and Mexico.
(4) Facilitate integration of relations between California and Mexico through cultural, social, educational, and economic exchange programs.
(d) The initiative may do all of the following:
(1) Facilitate establishment of procedures for reparation services Californians routinely require and that require cross-border and intrastate coordination, including, but not limited to, repatriation of human remains between California and Mexico and its individual states.
(2) Through the Mexico International Trade and Investment Program, promote trade and investment that creates California jobs, investment, and assist California companies and communities by connecting prospective investors or trading partners, helping expansion opportunities, and helping California companies to secure contracts in Mexico.
(3) Increase tourism opportunities in California.
(4) Work with higher education institutions to increase cultural and educational exchange opportunities.
(5) Seek improvements to border infrastructure, policies, and procedures that reduce border crossing wait times and improve air quality, water quality, public health, and environmental resources across our shared border.
(6) Support the Office of Emergency Services in binational disaster relief efforts.
(7) Increase opportunity for renewable energy and climate change policies and technology, including recycling.
(8) Develop Facilitate establishment of bilateral workforce development opportunities.
(9) Work with institutions of higher education in California to develop a process for students to complete their degrees in Mexico and to provide other educational services and support to repatriated students.
(10) Develop programs and cultural and educational exchanges to further California’s sister state relationships with Mexico.
(e) (1) The initiative may be staffed by California state government employees or individuals, nonprofits, or businesses under contract with the Governor’s Office of Business and Economic Development or a funding partner.
(2) Employees of the Governor’s Office of Business and Economic Development and other state departments approved by the Governor may travel outside of California whenever necessary to carry out the duties set forth in this chapter.

(e)

(f) (1) The costs associated with operation of the initiative, including the Mexico International Trade and Investment Program, shall be supported through private moneys. public and private sector moneys, including state General Fund moneys, if specifically appropriated for this purpose.
(2) This article shall be implemented only to the extent that sufficient private moneys are available for that purpose. The director of the Governor’s Office of Business and Economic Development shall notify the Department of Finance when sufficient moneys have been received. The director may establish separate implementation phases to correspond to distinct funding goals.
(3) Subject to subdivision (a) of Section 13997, the office may accept and administer private moneys received as grants, gifts, donations, and other financial support from private sources for purposes of this article.

(g) (1) The director shall may create an advisory board composed of eight individual contributors of private moneys or representatives of contributors to provide guidance to the Governor’s Office of Business and Economic Development with respect to overseeing the Mexico International Trade and Investment Program and creating a strategy for using metrics to evaluate the success of the program.
(2) The director may seek advice from any other state advisory board or commission in implementing this chapter, including the Commission on California-Mexico Affairs, established pursuant to Section 99531.
(h) (1) The Governor’s Office of Business and Economic Development shall annually report on its activities. At a minimum, the report shall include a list of activities, outcomes of those activities, and current and emerging issues impacting the California and Mexico relationship.
(2) The report shall be available through a link on the commission’s internet website within 90 days following the close of the fiscal year. A notice that this requirement has been met shall be provided to the Chief Clerk of the Assembly, the Secretary of the Senate, and the relevant policy and fiscal committees of both houses of the Legislature.
(3) Reports and recommendations provided to the Legislature pursuant to this part shall be submitted pursuant to Section 9795.
