An act to amend Section 560 of the Military and Veterans Code, relating to the military.

SB 745, as introduced, Roth. State Military Reserve.
Existing law prohibits an officer or enlisted person of the State Military Reserve from being arrested on any warrant, except for treason or a felony, while going to, remaining at, or returning from, a place the officer or enlisted person is ordered to attend for military duty. Existing law also exempts every officer and enlisted person, during the officer’s or enlisted person’s service, from any posse comitatus and from jury duty.
This bill would make technical, nonsubstantive changes to those provisions.

The people of the State of California do enact as follows:


SECTION 1.

 Section 560 of the Military and Veterans Code is amended to read:

560.
 (a) The Uniform Code of Military Justice (Chapter 47 (commencing with Section 801) of Title 10 of the United States Code) and the rules and regulations adopted thereunder, together with the Manual for Courts-Martial, United States, 1984 (Executive Order 12473 of April 13, 1984, as amended), are hereby adopted as part of this code and shall be applicable to and govern the State Military Reserve.
(b) No officer or enlisted person of the State Military Reserve may be arrested on any warrant, except for treason or a felony, while going to, remaining at, or returning from from, a place he or she the officer or enlisted person is ordered to attend for military duty. Every officer and enlisted person of the State Military Reserve is, during his or her the officer’s or enlisted person’s service, exempt from service upon any posse comitatus and from jury duty.
