An act to amend Section 65350.5 of the Government Code, relating to groundwater.

SB 838, as introduced, Durazo. City or county general plan: groundwater sustainability plan: groundwater management plan.
Existing law requires, before the adoption or any substantial amendment of a city or county’s general plan, the planning agency to review and consider, among other things, an adoption of, or update to, a groundwater sustainability plan, or ground water management plan, or groundwater management court order, judgment, or decree.
This bill would revise that requirement to require the planning agency to review and consider, among other things, a groundwater sustainability plan, groundwater management plan, or an alternative adopted or updated pursuant to specified groundwater management laws, or groundwater management court order, judgment, or decree. By imposing a new duty on a city or county, this bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:


SECTION 1.

 Section 65350.5 of the Government Code is amended to read:

65350.5.
 Before the adoption or any substantial amendment of a city’s or county’s general plan, the planning agency shall review and consider all of the following:
(a) An adoption of, or update to, a A groundwater sustainability plan or plan, groundwater management plan plan, or an alternative adopted or updated pursuant to Part 2.74 (commencing with Section 10720) of, or Part 2.75 (commencing with Section 10750) of of, Division 6 of the Water Code or groundwater management court order, judgment, or decree.
(b) An adjudication of water rights.
(c) An order or interim plan by the State Water Resources Control Board pursuant to Chapter 11 (commencing with Section 10735) of Part 2.74 of Division 6 of the Water Code.

SEC. 2.

 If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
