An act to add and repeal Article 7 (commencing with Section 33600) to of Chapter 4 of Part 20 of Division 2 of Title 2 of the Education Code, relating to state educational agencies.

Existing law establishes the State Board of Education and requires the state board to adopt rules and regulations, not inconsistent with the laws of the state, to govern the public elementary and secondary schools of the state. Existing law provides that the state board consists of 10 members, who are appointed by the Governor to 4-year terms with the advice and consent of 2/3 of the Senate. Existing law also provides for the appointment by the Governor, with the advice and consent of 2/3 of the Senate, of a student member to a single one-year term commencing on August 1. Existing law requires the state board to determine all questions of policy within its powers.
This bill would create the Student Board Member Advisory Commission in the state government consisting of 13 commissioners, including the student member of the state board, who is required to chair the commission, and 12 other voting student members who meet certain requirements, including representing prescribed regions of the state, and are appointed by the state board. The bill would require commissioners to serve one-year terms, and prescribe provisions pertaining to reappointment, vacancies, and reimbursement of expenses. The bill would require the commission to study and provide assistance and advice to the student member of the state board, the state board, the Superintendent of Public Instruction, the Legislature, and the Governor in education policy as it relates to the experience of the state’s pupils, and would require the commission to undertake certain other actions and activities.
The bill would repeal these provisions on January 1, 2028.

The people of the State of California do enact as follows:
SECTION 1.
Article 7 (commencing with Section 33600) is added to Chapter 4 of Part 20 of Division 2 of Title 2 of the Education Code, to read:Article 7. Student Board Member Advisory Commission
33600.
For purposes of this article, the following definitions apply:(a) “Commission” means the Student Board Member Advisory Commission established in Section 33601.
(b) “Commissioner” means a voting member of the Student Board Member Advisory Commission.
33601.
(a) There is in the state government the Student Board Member Advisory Commission consisting of the following 13 members:(1) The student member of the state board.
(2) Twelve commissioners appointed by the state board, upon the recommendation of the student member of the state board, subject to the following requirements:
(A) A commissioner shall simultaneously serve as a pupil member on a local school board.
(B) One commissioner shall reside, work, or attend school in each
region described in subdivision (b).
(b) For the purposes of subparagraph (B) of paragraph (2) of subdivision (a), the regions are defined as follows:
(1) Region One consists of the Counties of Butte, Del Norte, Glenn, Humboldt, Lassen, Modoc, Shasta, Siskiyou, Tehama, and Trinity.
(2) Region Two consists of the Counties of Alpine, Amador, Calaveras, Colusa, El Dorado, Nevada, Placer, Plumas, Sacramento, Sierra, Sutter, Yolo, and Yuba.
(3) Region Three consists of the Counties of Lake, Marin, Mendocino, Napa, Solano, and Sonoma.
(4) Region Four consists of the Counties of Alameda, Contra Costa,
San Francisco, San Mateo, and Santa Clara.
(5) Region Five consists of the Counties of Fresno, Inyo, Madera, Mariposa, Merced, Mono, San Joaquin, Stanislaus, and Tuolumne.
(6) Region Six consists of the Counties of Monterey, San Benito, and Santa Cruz.
(7) Region Seven consists of the Counties of San Luis Obispo, Santa Barbara, and Ventura.
(8) Region Eight consists of the Counties of Kern, Kings, and Tulare.
(9) Region Nine consists of the County of Los Angeles.
(10) Region Ten consists of the County of Orange.
(11) Region Eleven consists of the Counties of Riverside and San Bernardino.
(12) Region Twelve consists of the Counties of Imperial and San Diego.
(c) The state board shall take into consideration that the members of the commission represent the geographical, racial, ethnic, socioeconomic, cultural, physical, and educational diversity of the state’s youth. Particular emphasis and funding should be used to reach out to at-risk or disadvantaged youth to serve as members of the commission, as their participation will provide keen insight into many of the issues that youth face in their day-to-day lives.

(a) Commissioners shall serve one-year terms.(b) (1) The student member of the state board shall serve as the chair of the commission.
(2) The chair shall conduct the meetings, draft bylaws, serve as the primary liaison to the government, and oversee the formation of committees as necessary to accomplish the business of the commission.
(c) A commissioner may seek reappointment as long as they fulfill the requirements in subdivision (a) of Section 33601.
(d) (1) Attending a meeting of the commission as a
commissioner shall be a lawful excuse for a pupil to be absent from school, under paragraph (7) of subdivision (a) of Section 48205, if approved by the principal or a designated representative pursuant to uniform standards established by the governing board of the school district.
(2) If a pupil is excused from school attendance as described in paragraph (1), the pupil shall not be recorded as being absent on any date for which the excuse is operative and the pupil shall not be penalized by the school in any manner, including, but not limited to, in attendance records.
(e) A commissioner’s position becomes vacant, under the approval of the executive director of the state board, in the event of any of the following:
(1) Death of a commissioner.
(2) Resignation of a commissioner.
(3) Change in residence of a commissioner to outside of California.
(4) Failure of restorative practices for inappropriate conduct, unexcused absences, or inability to complete expected duties of a commissioner.
(f) In the event of a vacancy, the appointing power that appointed the commissioner shall appoint a replacement in the same manner as the original appointment within 30 days of the vacancy.
(g) The members of the commission shall serve without compensation, except they shall receive their actual and necessary expenses
incurred in the performance of their duties and responsibilities, including traveling expenses.
33603.
(a) The commission shall study and provide assistance and advice to the student member of the state board, the state board, the Superintendent, the Legislature, and the Governor in education policy as it relates to the experience of the state’s pupils. (b) The commission shall also do the following:
(1) Consult with any existing local-level youth advisory commissions and community-based, grassroots youth-led organizations for input and potential solutions on issues related to youth.
(2) Draft and approve resolutions that formally articulate the commission’s
positions on various youth-related education policies.
(3) Form committees and task forces to discuss specific issues and policy areas and meet as necessary.
(4) Conduct public hearings with community and youth organizations to identify pressing issues and debate priorities.
(5) Appoint advisory committees from within its membership or with outside members whenever necessary. Members of an advisory committee of the commission shall serve without compensation, but each may be reimbursed for necessary traveling and other expenses incurred in the performance of official duties.
(6) Conduct public awareness campaigns to raise awareness about the commission and to enhance
outreach to the youth in the state, as well as establishing pupil member positions on governing boards of school districts.
(7) Conduct periodic seminars for its commissioners regarding leadership, the education system, and the state board.
