AN ACT RESTRICTING THE USE OF METHOPRENE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective from passage) (a) On and after October 1, 2013, no person shall introduce any product containing methoprene (isopropyl(2E-4E)-11-methoxy-3,7,11-trimethyl-2,4-dodecadienoate) into any catch basin, brook, stream, river, lake, pond, sound or any other body of water, except as provided in subsections (b) and (c) of this section.

(b) Methoprene may be introduced into a catch basin, brook, stream, river, lake, pond, sound or any other body of water if the Commissioner of Public Health declares a public health emergency related to a life-threatening, mosquito-borne illness.

(c) Any application of methoprene permitted pursuant to subsection (b) of this section shall be performed only by a duly licensed applicator and in accordance with the federal Clean Water Act (33 USC 1251 et seq.).

(d) Any person who wilfully violates any provision of this section shall be guilty of a class A misdemeanor.

This act shall take effect as follows and shall amend the following sections:
