AN ACT CONCERNING THE REGISTRATION OF SELLERS OF ELECTRONIC NICOTINE DELIVERY SYSTEMS OR VAPOR PRODUCTS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Subsection (a) of section 21a-415 of the 2016 supplement to the general statutes is repealed and the following is substituted in lieu thereof (Effective from passage):

(a) On and after [March] October 1, 2016, no person in this state may sell, offer for sale or possess with intent to sell an electronic nicotine delivery system or vapor product unless such person has obtained an electronic nicotine delivery system certificate of dealer registration from the Commissioner of Consumer Protection pursuant to this section. An electronic nicotine delivery system certificate of dealer registration shall allow the sale of electronic nicotine delivery systems or vapor products. A holder of an electronic nicotine delivery system certificate of dealer registration shall post such registration in a prominent location adjacent to electronic nicotine delivery system products or vapor products offered for sale. An employee of a person holding a valid electronic nicotine delivery system certificate of dealer registration may sell, offer for sale or possess with intent to sell an electronic nicotine delivery system or vapor product without registering pursuant to this section, provided the sale, offer for sale or possession with intent to sell is authorized by the registration holder and is on premises owned or operated by the registration holder.

This act shall take effect as follows and shall amend the following sections:

To delay the registration deadline for sellers of electronic nicotine delivery systems or vapor products and to specify employees of dealers are not required to individually register.
