AN ACT CONCERNING COURT AUTHORITY TO ENTER ORDERS RELATING TO OUTPATIENT PSYCHIATRIC TREATMENT.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That chapter 801a of the general statutes be amended to authorize the probate court to issue orders for outpatient psychiatric treatment for any person who (1) is found by clear and convincing evidence to have a mental illness, based on a clinical determination, (2) is unlikely to survive in the community without supervision, (3) has a history of noncompliance with treatment, (4) is unlikely to voluntarily participate in outpatient treatment, and (5) is likely to cause serious harm to himself, herself or others.
Statement of Purpose:
To give the probate court the authority to require certain persons to submit to outpatient psychiatric treatment.
