AN ACT CONCERNING JURISDICTION IN HOMICIDE CASES.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
Section 1. (NEW) (Effective from passage) Whenever the body of a homicide victim is found in this state, the death shall be presumed to have occurred in this state and, if jurisdiction is based on this presumption, this state shall retain jurisdiction unless the defendant proves by clear and convincing evidence that: (1) The act that caused the death did not occur in this state, (2) the death did not occur in this state, and (3) the defendant did not engage in any conduct in this state that is an element of the offense.
This act shall take effect as follows and shall amend the following sections: | ||

Statement of Purpose:
To clarify jurisdiction for criminal prosecution purposes when the body of a homicide victim is found in this state.
