AN ACT DEFINING AND ESTABLISHING STANDARDS FOR THE PRACTICE OF TELEMEDICINE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That the general statutes be amended to (1) define the practice of telemedicine and establish standards for such practice, including, but not limited to, requiring (A) the telemedicine provider to be properly licensed to practice medicine in Connecticut, (B) written informed consent from the patient prior to the provision of telemedicine services, (C) the patient's medical records and health history to be made available to the telemedicine provider, (D) the telemedicine provider to have previously personally seen and examined the patient or be providing telemedicine services at the request of a Connecticut licensed health care provider who has personally seen and examined the patient, (E) all telemedicine services to comply with generally accepted standards of care, and (F) insurance coverage for such services to be provided on the same terms and conditions as in-person services and to not discriminate in favor or against telemedicine; (2) require that if the telemedicine services are being provided by an out- of-state provider who provides telemedicine services on a regular or routine basis or have been arranged by or through an insurer, then such provider shall (A) be registered with the Department of Public Health as a telemedicine provider, and (B) provide the patient with his or her registration number and information on how to file a complaint with the Department of Public Health should the patient have any complaints regarding the service provided; and (3) require the Department of Public Health to establish a telemedicine provider registry.

To establish standards and patient safeguards for the practice of telemedicine.
