AN ACT CONCERNING THE USE OF OFF-DUTY SCHOOL BUSES TO PROVIDE PUBLIC TRANSPORTATION.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
Section 1. (NEW) (Effective July 1, 2011) (a) The board of education of any school district may rent or lease, for such consideration as may be determined by such board, any motor vehicle owned by such school district and used for the transportation of children, when such vehicle is not required for such purpose, to: (1) A senior citizen center or organization that receives public funds; (2) a nonprofit incorporated organization serving senior citizens; (3) a nonprofit incorporated organization serving persons with physical or developmental disabilities; (4) a nonprofit organization providing recreation, youth services, or operating playgrounds or neighborhood recreation centers; (5) a school district, or municipal or state agency; (6) an operator of a public transportation district, or (7) any nonprofit organization, community-based organization or educational or employment and training agency which provided education or employment and training services for youths and adults.
(b) The cost of renting or leasing any such vehicle shall be not less than the full amount of the costs and expenses resulting from such rental or lease contract. As used in this subsection, "full amount of the costs and expenses" includes, but is not limited to: (1) The cost of operation, maintenance and repair of such vehicle; (2) the current fair market value of the vehicle, annualized for the vehicle's remaining useful life; and (3) the cost of public liability and property damage insurance, fire insurance and compensation insurance of drivers and the cost of collision insurance in the amount of the value of the vehicle to protect the renter or lessor.
This act shall take effect as follows and shall amend the following sections: | ||

Statement of Purpose:
To provide that the board of education of any school district may rent or lease any motor vehicle owned by such school district and used for the transportation of children, when such vehicle is not required for such purpose.
