HOUSE BILL NO. 120

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE FREEDOM OF INFORMATION ACT.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §10002(g) of Title 29 of the Delaware Code by inserting after the first sentence the following:

"For purposes of this chapter, the following records shall be deemed public:any non-security reports regarding State agencies or facilities paid for by public funds, no matter what the purpose, including but not limited to non-security reports made by national accreditation agencies involving a State agency or facility, or a facility operated under contract to or by a State agency; except that all personal identification data of a student, patient, ward of the State, or a recipient of State services, such as names, social security numbers, and any other information which may lead to the public identification of an individual, must be redacted.".



SYNOPSIS

This Bill deems as public reports any non-security reports regarding State agencies paid for by public funds, including accreditation reports of all State agencies, but only after all personal identification data of students, patients, wards of the State, and recipients of State services are redacted.
