HOUSE BILL NO. 151

AN ACT TO AMEND TITLE 1 OF THE DELAWARE CODE RELATING TO DISTRIBUTION OF THE DELAWARE CODE AND SUPPLEMENTS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §108, Chapter 1, Title 1, Delaware Code by striking said section in its entirety and substituting in lieu thereof the following:

"§ 108.Distribution of Code and supplements.

(a)                 All State, legislative, executive, judicial, or other State governmental entities shall have the Delaware Code available electronically.

(b)                 Each State agency desiring printed copies of the Delaware Code and supplements thereto purchased by the State shall annually certify to the Director of Government Support Services the exact number of printed copies that agency requires and the reason such copies are necessary by September of each year.

(c)                 Legislative Council shall be responsible for budgeting the necessary funds to provide copies of the Delaware Code and supplements.Any additional copies of the Delaware Code over current allocations shall be the responsibility of the requesting agency.Special orders, such as individual titles, shall continue to be the responsibility of each agency.".

Section 2.This Act shall be effective July 1, 2011.


SYNOPSIS

This bill recognizes that the Delaware Code is now available online and that fewer printed copies of the Delaware Code are necessary.The current Code outlines a minimum number of printed copies to be provided to each agency and certain officials throughout the State.Many agencies have requested fewer printed copies, but the current Code and policy requires Legislative Council to provide them.All copies and supplements are paid centrally by Legislative Council.Any additional copies of the Delaware Code will become the responsibility of the requesting agencies.
