HOUSE BILL NO. 156
AN ACT TO AMEND THE CHARTER OF THE CITY OF REHOBOTH BEACH RELATING TO THE CITY MANAGER’S DELEGATION OF SUPERVISORY AUTHORITY OVER CITY EMPLOYEES, INCLUDING BEACH PATROL EMPLOYEES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1. Amend Section 17 of the Charter of the City of Rehoboth Beach by making insertions as shown by underline and deletions as shown by strikethrough as follows:
(a) The Commissioners of Rehoboth Beach shall appoint a City Manager who shall be Chief Administrative Officer of the City. Notwithstanding any provision to the contrary, the City Manager shall supervise all City employees, and may delegate such supervisory authority in the City Manager’s discretion.
Section 2. Amend Section 21 of the Charter of the City of Rehoboth Beach by making insertions as shown by underline and deletions as shown by strikethrough as follows:
(e) The Rehoboth Beach Patrol shall be composed of a Captain of the Beach Patrol and such other members or subordinates as the Commissioners City Manager may from time to time deem necessary.
(f) The Commissioners City Manager, acting on behalf of the Commissioners, shall have the power to establish rules and regulations covering the qualifications of members of the Beach Patrol; provided, however, each member of the Beach Patrol shall pass a test substantially equal to the test required of a Senior Lifesaver by the American Red Cross. obtain a lifeguard certification from the American Red Cross or United States Lifesaving Association or pass a test substantially equal to such certification.
(g) Compensation to be received by the members of the Rehoboth Beach Patrol shall be fixed by the Commissioners. They The Captain of the Beach Patrol shall be under the direct control of the City Manager , or such other employee of the City that the City Manager may designate ; provided, however, that in cases of emergency members of the Rehoboth Beach Patrol may be called upon by the Chief of the Police Force to assist the members of the Police Force in the performance of their duties. In such cases, each member of the Beach Patrol shall be vested with all the authority of a member of the Police Force.
(h) The Rehoboth Beach Patrol shall be in direct charge of the preservation of human life along the beachfront of the City. The Beach Patrol shall restrain and suppress careless, dangerous or wanton unseemly conduct to bathers and swimmers by individuals along the beachfront of the City. They shall restrain and suppress unseemly conduct. They shall enforce regulatory measures adopted by the Commissioners and shall have such other duties as the Commissioners City Manager or the City Manager’s designee shall, from time to time, prescribe.
(i) In the performance of their duties, the members of the Rehoboth Beach Beach Patrol shall be vested with all the powers and authorities of a member of the Police Force of the City.
SYNOPSIS
This Act amends the Charter of the City of Rehoboth Beach to provide that the City Manager may delegate supervisory authority, including supervisory authority over the City’s Beach Patrol. This Act also clarifies that the City Manager has the authority to determine the composition of the Beach Patrol and establish rules and regulations covering the qualifications of members of the Beach Patrol. This Act also deletes provisions vesting members of the Beach Patrol with all the authority of a member of the Police Force. This Act also further clarifies the duties of the Beach Patrol in connection with its charge to preserve human life along the beachfront of the City.
