AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO THE CONSTRUCTION OF WATER ANDIRRIGATION WELLS. |
Section 1.Amend §6004(c)(3), Title 7 of the Delaware Code by deleting "50,000" and substituting in lieu thereof "1,000,000".
Section 2.Amend §6010, Title 7 of the Delaware Code by adding a new subsection (i) to read as follows:
"(i) The Secretary may waive the advertisement and hearing requirements of §6004(b) for irrigation wells if:
(1) The permit application is submitted between April 1 and October 1, inclusive;
(2) The permit application is to replace an existing irrigation well;
(3) The existing well has a valid allocation permit; and
(4) The replacement well will not exceed allocation permitted amounts.".
SYNOPSIS
Section 1 of this bill raises the limit of the exemption from the newspaper advertising and hearing requirements for water well construction permit applications to 1,000,000 gallons per day under normal operations. Section 2 of this bill changes the criteria for irrigation wells that are subject to public notice requirements and waives the public notice requirements for replacement irrigation wells that have previously received a permit and been publicly noticed. This will allow the Department of Natural Resources and Environmental Control to issue irrigation well construction permits, during the growing season, in a more expeditious manner.A delay in issuance of irrigation well construction permits can ruin an entire growing season's crop and the resultant economic impact can be significant.
