HOUSE BILL NO. 179
AN ACT TO AMEND TITLE 17 OF THE DELAWARE CODE RELATING TO ENTRANCE PERMITS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend § 146, Title 17 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:
§ 146. Access to state-maintained highways.
(g) The Department shall issue an entrance permit to a private or public utility upon presentation to the Department of a satisfactory entrance permit application signed by the private or public utility, where the private or public utility owns or has an easement for the entrance location.
SYNOPSIS
This Act requires the Department of Transportation to issue an entrance permit to a private or public utility upon presentation of a satisfactory entrance permit application where the private or public utility owns or has an easement for the entrance location.
