HOUSE BILL NO. 240

AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO REGULATIONS AND PROHIBITIONS CONCERNING GAME AND FISH.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §925, Title 7 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§925 Fishing with explosives, chemicals, poisons and other devices; exception for Department and agents.

(b) The use of electric lights shall be illegal for commercial fishing, except lights required by the U.S. Coast Guard and lights used for illumination for visual purposes.


SYNOPSIS

The use of electric lights to attract fish while fishing was banned to control fishing harvest before the establishment of management measures such as fishing size and creel limits and closed seasons. The current law prevents the use of electric lights needed to aid in targeting invasive finfish species such as snakeheads at night. This bill continues the illegality of using electric lights for commercial fishing.
