AN ACT TO AMEND TITLE 24 OF THE DELAWARE CODE RELATING TO PROFESSIONS AND OCCUPATIONS. |
Section 1.Amend §2532, Title 24 of the Delaware Code by labeling the existing paragraph as "(a)" and then adding new subsection §2532(b) as follows:
"(b)Upon request by a person for such person's pharmacy records, a pharmacy shall provide such records, in hard copy paper form (unless such person agrees to another form), as soon as is reasonably possible, but by no later than fifteen (15) business days after such person has made the request to the pharmacy, unless an emergency or a medical condition dictates that such records should be produced immediately.Nothing herein shall be construed as limiting or lessening the pharmacy's obligations to maintain confidentiality of such records and the pharmacy shall follow such pharmacy's standard procedures to ensure maintenance of confidentiality of such records.".
SYNOPSIS
This bill would require a pharmacy to provide to a person who requests their pharmacy records to be provided such records.In addition, the bill requires the pharmacy to follow the pharmacy's standard protocol, when producing the records, to ensure confidentiality of the records. |
