HOUSE BILL NO. 26

AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO EXEMPTIONS OF LICENSING REQUIREMENTS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend §502, Title 7 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

(m) Eligible Participants, as defined in §9403 of Title 16, are exempt from the hunting and fishing license requirements of this chapter.Persons providing attendant services, as defined in §9403 of Title 16, to the Eligible Participants are exempt from the hunting and fishing license requirements of this chapter while providing these services to the Eligible Participants.

SYNOPSIS

Currently only persons who are blind are exempt from hunting and fishing license requirements. This amendment will provide a hunting and fishing license exemption (not trapping) to all persons who have a severe, chronic mental or physical disability. As the person having these disabilities is often unable to participate in hunting and fishing requirements without assistance, any person providing attendant services for these individuals is also temporarily exempt.
