HOUSE BILL NO. 281

AN ACT TO AMEND SUBCHAPTER II, CHAPTER 80, TITLE 15 OF THE DELAWARE CODE RELATING TO ELECTIONS AND CONTRIBUTION LIMITS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §8012, Subchapter II, Chapter 80, Title 15 of the Delaware by making deletions as shown by strikethrough and insertions as shown by underline as follows:

(h) Any contribution made by more than 1 person shall include the signature of each contributor on the check, money order, or other negotiable instrument or in a separate writing.Upon receipt of any contribution made by more than 1 person and not signed by each contributor, the political committee may (1) request permission to reattribute the contribution and receive written notice from each contributor indicating the amount that should be attributed to each contributor, or (2) reattribute automatically, if the political committee, within 60 days of receipt of the contribution, notifies each contributor in writing of how the political committee attributed the contribution and that the contributor may request a refund if the contribution was not intended to be a joint contribution.


SYNOPSIS

This Bill clarifies how joint contributions to a political committee are to be attributed.This provision parallels federal law relating to joint contributions.
