HOUSE BILL NO. 38

AN ACT TO AMEND TITLE 2 OF THE DELAWARE CODE RELATING TO CHARTER BUS ACTIVITIES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend §1801(11), Title 2 of the Delaware Code by redesignating subparagraphs (ii) and (iii) as (iii) and (iv) respectively and inserting a new subparagraph (ii) to read:

"transportation to and from non-school related events by school bus operators under the regulation of the Department of Education, where such non-school related transportation is a de minimis portion of the carrier's operation.".

SYNOPSIS

This Bill will exempt from public carrier regulation those school bus operators that also provide charter bus activities for non-school related activities through the year to supplement their operations
