AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE RELATING TO CONTROLLED SUBSTANCES |
Section1.Amend §4740, Title 16 of the Delaware Code by striking the word "licensed" where it appears before the words "pharmacy technician" in paragraph (a)(2).
SYNOPSIS
This bill
corrects an error in the Delaware Code provision relating to the sale of
pseudoephedrine or ephedrine. The law currently provides that a licensed
pharmacist, sales clerk or "licensed pharmacy technician" shall require that
any person purchasing, receiving, or otherwise acquiring any substance
containing pseudoephedrine or ephedrine shall be age 18 or older and show a
photo ID.The law requires
pharmacists, sales clerks and "licensed pharmacy technicians" to check for ID
and to maintain a written log of all pseudoephedrine or ephedrine that is
dispensed.The problem is that there
